Peculiarities of obtaining a permit for the export of microelectronics from Russia
Microelectronic products belong to the category of products, the export of which is regulated by the requirements for military and dual-use products in accordance with the law of the Russian Federation on export control and the decree of the President of the Russian Federation on the list of goods in respect of which export control is established. For military microelectronic products, a license is required for export from Russia to foreign countries. Products that do not fall into the military and dual-use product category are required to obtain a conclusion that they do not belong to these categories.
Such permits and opinions can be obtained from the Ministry of Industry and the FSTEC of Russia. Until recently, conclusions were issued for each specific contract, therefore, when exporting the same product to one country under different contracts, several conclusions had to be drawn up. the cost of issuing such conclusions is constantly growing, so it is advisable to issue them for specific types of products and the country of export, and not for a specific contract. one should be prepared for the FSTEC to try to reduce export opportunities or divide them into several conclusions, each of which will have to be paid for. then the specialists of the exporting company will have to study the regulatory documents on export control and prove their case. by the way, the exporter should already be accustomed to this by tax, customs and other authorities.
